Terms of Service (TOS)

These Terms of Service ("Terms") constitute a legally binding agreement made between you ("User," "you," or "your") and Your Office SOS ("we," "us," or "our"), governing your access to and use of our website, digital marketing agency services, web hosting, CRM software, and automated sales platform (the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree with all of these Terms, you are prohibited from using the Platform and must discontinue use immediately.

1. Description of Services

Your Office SOS provides an all-in-one sales and marketing suite, including but not limited to: landing page and website builders, CRM pipeline management, automated follow-up campaigns (SMS, email, voicemail), appointment scheduling, web hosting, and digital marketing consulting services.

2. Account Registration & Responsibilities

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration. You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3. Pricing, Billing, and Cancellations

Subscription Fees: We offer various pricing tiers (including Web Hosting, BCH Members, Standard, and Premium plans, along with onboarding fees). By selecting a paid plan, you authorize us to charge your payment method on a recurring monthly or annual basis as selected.

No Contracts & Cancellations: There are no long-term binding contracts. You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellations take effect at the end of the current billing cycle.

Refunds: We strive for client satisfaction and offer a money-back guarantee on select promotional terms as explicitly advertised on our checkout pages. Unless otherwise stated in a specific promotional guarantee, subscription fees are generally non-refundable once the billing cycle has commenced.

4. Acceptable Use & Compliance with Marketing Laws

You agree to use the Platform strictly for lawful purposes. Because our Platform enables outbound communication (SMS, Voice, Email), you are solely responsible for compliance with all applicable local, state, and federal laws, including but not limited to:

The Telephone Consumer Protection Act (TCPA).

The CAN-SPAM Act.

A2P 10DLC registration and carrier messaging regulations.

You explicitly agree NOT to:

Send unsolicited spam, cold SMS campaigns without documented consumer opt-in consent, or deceptive marketing materials.

Upload or transmit viruses, malicious code, or scrape data from the Platform.

Use the Platform to harass, abuse, defraud, or harm others.

Attempt to reverse-engineer, decompile, or copy the underlying GoHighLevel/Your Office SOS software architecture.

We reserve the right to immediately suspend or terminate any account found violating telecom carrier guidelines, sending unauthorized spam, or engaging in illegal activities, without refund.

5. Intellectual Property Rights

Our Property: The Platform, including its custom scripts, templates, workflows, design, branding, and underlying software, is the exclusive property of Your Office SOS and its licensors.

Your Property: You retain full ownership of all data, client lists, content, and materials you upload into your CRM workspace ("Customer Data"). You grant us a limited, secure license to host and process your Customer Data solely for the purpose of providing the Services to you.

6. Disclaimer of Warranties & Limitation of Liability

The Platform and agency services are provided on an "AS IS" and "AS AVAILABLE" basis. While we provide advanced tools and data-driven strategies, we do not guarantee specific financial results, conversion rates, or business growth.

To the fullest extent permitted by law, Your Office SOS shall not be liable for any indirect, incidental, consequential, or punitive damages (including lost profits, lost data, or telecommunication carrier fines resulting from your failure to maintain proper messaging consent) arising out of your use or inability to use the Platform. In no event shall our total liability exceed the amount you paid to us in the six (6) months preceding the claim.

7. Indemnification

You agree to defend, indemnify, and hold harmless Your Office SOS, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your improper use of the Platform, or your failure to comply with SMS/Email marketing laws and TCPA regulations.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in California.
